TERMS OF THE AGREEMENT:
Price: USD$X,000. / Including applicable
Taxes, Handling and Shipping to the buyer.
Payments: Number (XX) consecutive monthly payments of
USD$X00. starting Month 00, 2009
This Painting will be shipped to the buyer within seven days
after the confirmed process of the first payment.
CERTIFICATE OF AUTHENTICITY:
A Certificate of Authenticity will be issue to the buyer upon
reception of the first payment. At full completion and total
payment of the Painting (
USD$X,000.
), a new Certificate of Authenticity will be issued to the buyer
with the artist’s signature.

TERMS AND CONDITIONS:
1- Guaranty: The buyer has ten
days to return the painting if he/she is not 100% satisfied.
2- The lost or damage to the
artwork become the responsibility of the buyer the day of its
arrival at the buyer’s address.
3- The buyer is responsible for
the return of the painting in undamaged condition.
4- During the course of this
Agreement, the buyer is granted a onetime privilege, would
he/she chose to, to exchange its painting for another one of its
choosing and of the same size-dimension.
5- If the buyer cannot complete
the payments of his painting, it will be replaced by another
artwork of equivalent value of the total payments made so far,
according with the market prices as indicated on the artist’s
website: ww.cerjlalonde.com
6- The buyer is responsible for
the shipping of the painting after its first delivery following
the signature of this contract.
7- This Contract-Agreement shall
remain confidential and the buyer further agrees that he will
not, during and after the effective date of this Agreement,
disclose the terms of this Agreement with any other party,
person or organization, except for the Certificate of
Authenticity which can be disclosed.
8- Reservation of Rights: All
Copyrights are retained by the Artist, including any electronic
rights or publication for commercial use.
9- In the event that a suit or
action is filed to enforce this Agreement or with respect to
this Agreement, the prevailing party shall be reimbursed by the
other party for all costs and expenses incurred in connection
with the suit or action, including, without limitation,
reasonable attorney’s fees at the trial level and on appeal.
This
Agreement shall be governed by and shall be construed in
accordance with the laws of the state of Florida. Exclusive
venue for any action arising under or in connection with this
Agreement shall lie in state court in Dade County, Florida. |
